Mass Tort Status Sought for Suits Over Toxins at Former Ford Site
Ford Motor and two co-defendants are seeking mass tort designation for multiple suits involving 656 plaintiffs who are seeking damages for health hazards from a New Jersey toxic landfill near a former Ford plant. New Jersey's acting administrative director of the courts has issued a notice to the state Bar giving interested parties until Oct. 12 to comment on the request. Last July, Ford and other defendants unsuccessfully tried to remove litigation over the Ringwood Mines Landfill Site to federal court.Claim Fails for Lack of Notice
The New York Court of Appeals held that the tort claims notice requirements of Virginia and Maryland govern, under the doctrine of comity, in a New York-filed action on behalf of a woman who may have received infected injections of human growth hormone. The decision upholds the dismissal of suits lodged against the University of Virginia and the University of Maryland School of Medicine by the estate of Stacey Crair.Notice Requirement Waived in Over 200 Suits Claiming Injuries From 9/11 Efforts
More than 200 lawsuits filed against New York City by people who allegedly suffered injuries when exposed to toxics during 9/11 rescue-and-cleaning efforts will go forward following a Manhattan judge's decision to allow late claim notices. Attorneys for the petitioners argued that the majority of their clients did not realize until long after the 90-day period to file a notice of claim had expired that their symptoms might be related to the noxious atmosphere surrounding Ground Zero.9/11 Suit Goes Federal, Not State

New York City's argument for immunity from thousands of respiratory damages claims against itself and the contractors who cleaned up the World Trade Center site ran into some tough questions in oral arguments before the 2nd Circuit. The court barely let the attorney representing the city clear his throat before it aggressively questioned the city's jurisdiction to appeal, pretrial, a lower court's decision to deny immunity. The attorney barely had time to address the merits of the immunity claim.Participation in Racist Float Ruled to Be Protected Speech
Former New York Mayor Rudolph Giuliani and the heads of the police and fire department violated the First Amendment when they fired three employees for participating in a racist float during a 1998 Labor Day parade in Broad Channel, Queens, a federal judge ruled Tuesday.Plaintiffs in Ford Landfill Suit Need Not Individually Prove Injuries Before Proceeding
Residents of a New Jersey town bordering a toxic landfill need not pre-prove their damages in order to go forward with a suit against Ford Motor Co. and others. A federal judge denied a defense motion for a case management order that would have required each of over 700 plaintiffs to specify injuries and produce evidence the injuries were caused by toxins from the site. Magistrate Judge John Hughes ordered that instead, discovery concerning causation could be conducted for five "bellwether" plaintiffs.N.J. High Court Designates Ford Toxic Landfill Suits as Mass Tort
The New Jersey Supreme Court has granted mass-tort designation, at the request of Ford Motor Co. and other defendants, to multiple suits seeking damages for alleged health hazards from a toxic landfill in Passaic County near a former Ford plant. The defendants had argued that the claims by 656 plaintiff homeowners who live on or near the site arise from the same set of facts and plead similar injuries, and that centralized management would save money and streamline the process.State AI Legislation Is on the Move in 2024
