Residents of a New Jersey town bordering a toxic landfill need not pre-prove their damages in order to go forward with a suit against Ford Motor Co. and others. A federal judge denied a defense motion for a case management order that would have required each of over 700 plaintiffs to specify injuries and produce evidence the injuries were caused by toxins from the site. Magistrate Judge John Hughes ordered that instead, discovery concerning causation could be conducted for five "bellwether" plaintiffs.
