Mass Tort Status Sought for Suits Over Toxins at Former Ford Site

Ford Motor and two co-defendants are seeking mass tort designation for multiple suits involving 656 plaintiffs who are seeking damages for health hazards from a New Jersey toxic landfill near a former Ford plant. New Jersey's acting administrative director of the courts has issued a notice to the state Bar giving interested parties until Oct. 12 to comment on the request. Last July, Ford and other defendants unsuccessfully tried to remove litigation over the Ringwood Mines Landfill Site to federal court.

New York City's argument for immunity from thousands of respiratory damages claims against itself and the contractors who cleaned up the World Trade Center site ran into some tough questions in oral arguments before the 2nd Circuit. The court barely let the attorney representing the city clear his throat before it aggressively questioned the city's jurisdiction to appeal, pretrial, a lower court's decision to deny immunity. The attorney barely had time to address the merits of the immunity claim.

Residents of a New Jersey town bordering a toxic landfill need not pre-prove their damages in order to go forward with a suit against Ford Motor Co. and others. A federal judge denied a defense motion for a case management order that would have required each of over 700 plaintiffs to specify injuries and produce evidence the injuries were caused by toxins from the site. Magistrate Judge John Hughes ordered that instead, discovery concerning causation could be conducted for five "bellwether" plaintiffs.
