The Path Gets Rocky and Steep

The past year has been a rough ride for the plaintiffs' bar. Notwithstanding notable successes including billon-dollar verdicts and settlements against former lead paint manufacturers, Nortel, Sempra Energy and USG, the litigation system is showing the effects of a well-laid campaign to rein in mass torts, according to plaintiffs' and defense experts. "It's not that it's been a bad year as much as it's been a bad 10 years," said Stephen Daniels, a senior researcher at the American Bar Foundation in Chicago.

Santa Clara and San Francisco counties have sued numerous natural gas providers, arguing the companies stole billions from California consumers. Filed by Cotchett, Pitre, Simon & McCarthy, the suits claim that the gas distributors engaged in "unfair and deceptive conduct" that pushed gas prices to six times the national average, according to a news release.
