The Return of an Innovative SEC Enforcement Technique

The SEC's enforcement of the prohibition on insider trading has traditionally been directed at domestic actors, but that focus changed in landmark cases where the SEC obtained interim, emergency relief against "unknown purchasers" of securities. New cases show the SEC is again looking beyond U.S. borders and having success in convincing courts to order interim relief without fully articulating the factual predicate for a legal theory. As world markets integrate, use of these strategies is apt to increase.
