Insurer Pays Only for Counsel It Selects, 5th Circuit Rules

In an Oct. 15 unpublished opinion, a three-judge panel of the 5th U.S. Circuit Court of Appeals affirmed a trial court ruling that upheld an insurance company's right to select defense counsel to represent Houston-based Coats Rose Yale Ryman & Lee in a legal malpractice suit. The insurer does not need to reimburse Coats Rose for the legal fees it paid to counsel the firm selected, the appeals court affirmed.

Republicans Win Appellate Court Nailbiter Races

Jim Sharp wasn't feeling too sharp the morning of Nov. 5. He'd been up all night watching election returns -- results that eventually showed he had become the first Democrat elected to Houston's 1st Court of Appeals in more than a decade. Sharp's win means something, several political observers say: Intermediate appellate courts in large urban counties &#151 especially in Dallas and Houston &#151 are no longer seen as the completely safe seats for Republicans they once were.
