Litigation Over Collapse of Casino Garage Settles for $101 Million

Litigation over the 2003 parking garage collapse at Atlantic City, N.J.'s Tropicana Casino Resort that killed four workers and injured 32 others has settled for $101 million, lawyers in the case announced Wednesday. The settlement was the product of three months of negotiations under the auspices of a Superior Court judge whom the parties asked to monitor the case after private mediation failed. Defendants included contractors, engineering and architectural firms, and the corporate owners of the Tropicana.

Pa., N.J. Federal Courts Greenlight Class Actions Over Gift Card Fees

In a major setback for banks, federal judges in Pennsylvania and New Jersey have refused to dismiss a pair of class action consumer suits against TD Bank over allegedly deceptive practices used to market gift cards. In both decisions, the judges rejected TD Bank's argument that such suits, brought under state consumer protection laws, are pre-empted by the federal National Bank Act. At issue are so-called "dormancy fees" charged by TD Bank that reduce the value of gift cards each month after a period of non-use.

Buchanan Ingersoll and Klett Rooney Lieber & Schorling will merge on July 1, as approved by the firms' shareholders Tuesday. Buchanan Ingersoll & Rooney will be the largest firm in Pennsylvania, with roughly 313 lawyers in the state, and more than 525 nationwide. Bush Official Apologizes for Slap at Lawyers for Detainees

A Department of Defense lawyer apologized Wednesday for his comments suggesting that corporations boycott law firms that represent detainees at the Guantanamo Bay detention facility. In a letter to The Washington Post, Charles Cully Stimson said the comments, made during a radio interview, "do not reflect my core beliefs." His apology came two days after the Pentagon disavowed his statements, saying they did not represent Defense Department views. The remarks had touched off a salvo of criticism.

Is Mentoring the Cure for Minority Attorney Woes?

At a diversity conference held last week at Wolf, Block, Schorr & Solis-Cohen, associates said their identity as minority members has led to false perceptions of skill sets and a diminished caseload. One black associate said she was working at her second firm after the only work generated from the first was the overseeing of contract attorneys as they handled document review. But it's not much better at the second firm, she said. Panelists increasingly pointed to the importance of mentors as a solution.
