The Circuit will once again address its strict ascertainability requirement for class certification in the case 'In re Niaspan Antitrust Litigation.' This appeal represents the first ascertainability case in the Third Circuit that focuses on the pharmaceutical industry and the ability to identify, through expert testimony, who paid for prescription drugs.

"This is the gig economy: on-demand jobs, supplemental income, tradeoffs between stability and flexibility, and a market where many drivers use multiple apps at once, such as Uber and Lyft, or multiple platforms, such as Uber Rides and Uber Eats, to earn the equivalent of full-time pay. It is inappropriate to exclude this type of work and these kinds of drivers from the nature of Uber's business or the core activities of the class," Chief Judge Freda Wolfson wrote.
