Three years after enactment of a New Jersey law allowing courts to take away guns from people posing a risk to themselves or others, an Atlantic County case highlights the thorny task of deciding who falls under the law’s definition of unstable.

An appeals court ordered a new hearing Wednesday after a judge denied a petition under the state’s “Red Flag” law to seize firearms from a woman who was seen in a Facebook video dancing in her driveway while brandishing a pink handgun. That judge failed to admit certain critical evidence and to make findings of fact before rejecting the application, the appeals court ruled.
