An intermediate New York appeals court on Wednesday ruled that a group of active and retired Corrections Officers had no standing to sue the Corrections Officer Benevolent Association, its board, or its law firm Koehler & Isaacs for derivative actions relating to the investment of union money.

The Appellate Division, Second Department ruling found that the plaintiffs “lack standing to assert derivative claims on behalf of the nominal defendant COBA because they do not represent five percent or more of any class of members of COBA.”
