The Massachusetts Supreme Judicial Court affirmed a lower court’s $8.8 million judgment against a New England-based furniture retailer, finding its draw compensation plan for its commissioned sales employees violated overtime and Sunday pay statutes.

After hearing oral arguments in the fall, the state high court was tasked with considering whether Jordan’s Furniture’s commissions-based compensation scheme for its sales employees complied with the overtime statute and Sunday pay statute. The SJC unanimously affirmed the Superior Court’s holding, which found Jordan’s violated both statutes.
