In a petition filed to the justices Wednesday, attorneys for restaurant owner Joseph Tambellini said a ruling from the Supreme Court on the issue could provide guidance to the "hundreds, if not thousands," of lawsuits expected to result from the statewide closures Gov. Allstate Fire & Casualty Insurance will have to wait to appeal a federal judge's ruling interpreting the Pennsylvania Supreme Court's 2019 decision in 'Gallagher v. Geico' as invalidating the "household vehicle exclusion," commonly used in motor vehicle policies. U.S. District Judge Wendy Beetlestone of the Eastern District of Pennsylvania said the case must proceed to the class certification phase before an appeal can be taken.
