Conviction Upheld Despite 'Emotionally Upset' Juror
A Manhattan judge properly denied a defendant's request to conduct an inquiry regarding an "emotionally upset" juror who locked herself in a bathroom during deliberations, a New York appellate court ruled on Tuesday. According to court records, a distraught juror shut herself in a courthouse bathroom for about 75 minutes during a trial involving charges of selling a controlled substance.Wayland led the DOJ team that won Monday's ruling permanently enjoining H&R Block from completing its planned $287.5 million acquisition of TaxAct maker 2SS Holdings Inc. The decision, which followed a nine-day bench trial, is a stand-out victory for the DOJ in its first litigated merger case since 2004, and it doesn't bode well for AT&T and T-Mobile as they face off against Wayland to defend their own proposed merger.

Judges are known to enhance jury awards, but rarely do they multiply a verdict tenfold the way a New Jersey judge did this week. Judge Robert Brennan increased to $1 million a $100,000 award for pain and suffering from a snowmobile accident that cost plaintiff Dennis Mohr a leg. Mohr's lawyer says that the judge found the $100,000 award to be a "jury mistake" and that $1 million was the lowest fair and reasonable amount. Brennan gave defendant Yamaha Motor Co. 20 days to accept the additur or face a retrial of damages.New York Judge Finds Business Owner Must Testify Despite Anxiety
