For the second time in a week, a Florida trial judge has declared the state Asbestos and Silica Compensation Fairness Act unconstitutional when applied retroactively. Broward County Circuit Judge David Krathen wrote his order in the cases of 10 asbestos plaintiffs that are before him, but his decision affects all those bringing liability claims against manufacturers and distributors of asbestos and silica in Broward Circuit Court.
