The Rule 263 Trial By Agreement

Texas Rule of Civil Procedure 263 provides a time- and cost-saving process by which lawyers can present a case to the court, write J. Allen Smith and Bradley E. McLain. It permits attorneys to submit the entire case by an agreed statement of facts, dispensing with the need to present any evidence in open court. In a Motion for Judgment on Agreed Statement of Facts under Rule 263, the court need only determine the applicable law and apply it to the agreed facts and evidence submitted by agreement of the parties.
