Wal-Mart Suit Could Be Boon for Plaintiffs Bar

Tuesday's certification of the historic Wal-Mart sex discrimination class action could funnel tens of millions of dollars in fees to the lean nonprofit firms on the plaintiffs' legal team. But experts noted the decision would likely face an almost immediate challenge. Under a relatively new rule, Wal-Mart can appeal the certification within 10 days to the 9th Circuit, which would have discretion over whether to take up the case.

RAM Ruling Portends a New E-Discovery Brawl

A federal magistrate's order that stops a Web site from routinely tossing relevant data could, if replicated, carry broad e-discovery implications. Magistrate Judge Jacqueline Chooljian's order requires TorrentSpy to turn over customer data only ephemerally kept in its computers' random access memory, or RAM. It could result in floods of similar requests in other civil cases, according to Ira Rothken, the Novato, Calif.-based attorney for the TorrentSpy site. The order also has privacy watchdogs concerned.
