Federal prosecutors have filed criminal charges against 14 individuals in connection with the government's insider-trading investigation of the Galleon Group hedge fund, one of whom is an associate at Ropes & Gray: Arthur Cutillo, a litigation associate in the firm?s New York office. Another individual arrested in the investigation, Michael Kimelman, a trader and founding partner of Incremental Capital, previously worked as an associate at Sullivan & Cromwell.

EEOC Looks at Caregiver Bias

The EEOC recently announced that it may develop enforcement guidelines to address the growing problem of "family responsibility discrimination," which has led increasing numbers of employees to sue employers for discriminating against them because of caregiving responsibilities. No federal law expressly prohibits caregiver discrimination, so FRD plaintiffs have pursued claims under a variety of state and federal laws. Employers fear that the EEOC may take action that makes it easier for FRD plaintiffs.

Bankruptcy Rulings Clear Up Circuits

The Supreme Court resolved two problems deeply dividing the federal circuits by refusing to read into the bankruptcy code what was not expressly there. The Court held that only the trustee for a bankruptcy estate -- and not an insurance company -- can recover administrative expenses. On the same day, the justices held that bankruptcy does not change the burden of proof on a tax claim.
