Federal Judge in N.Y. Named Mediator for Enron Litigants

Southern District of New York Senior Judge Kevin T. Duffy was named the mediator among litigants in Enron's shareholder and bankruptcy cases in an unusual joint order issued Wednesday by the judge in New York overseeing Enron's bankruptcy and the judge in Texas handling the shareholder litigation. Duffy is notoriously tough and forthright, traits many lawyers said may prove ideal for such a complex settlement discussion.

Rabi Abdullahi, in which the 2nd Circuit revived the claims of Nigerians who allege they were grievously harmed by a Pfizer drug in a government-approved clinical trial.

Plaintiffs' lawyers rushed to Alexandria, Va., last week to file at least 15 stock fraud class actions against Virginia-based MicroStrategy on news that the company had to dramatically restate earnings for the past two years. While the cases are not the first stockholder suits to be filed in the Eastern District, local litigators and attorneys for emerging companies see the flurry as a signal of stormy weather ahead.

A promise to set aside $20 million for cardholders who were overbilled will not impede a swell of litigation against Providian Financial, a credit card company with a trail of disgruntled customers. A 3rd U.S. Circuit Court of Appeals panel ruled that union health and welfare funds cannot prove the tobacco industry caused them to spend more money on health care for workers. The unanimous ruling in Steamfitters Local Union No. 420 v. Philip Morris affirmed an April 1998 decision dismissing the class-action antitrust and RICO suit brought by seven Pennsylvania-based union health and welfare funds against eight tobacco companies.
