Court Doesn't Snuff Out Consumer Antitrust Litigation Over Snuff Prices

Eastern District of Pennsylvania Judge Ronald L. Buckwalter has refused to dismiss a consumer suit filed in Philadelphia alleging that leading U.S. snuff manufacturer UST used its monopoly power to drive up prices. The plaintiffs seek to capitalize on rival Conwood's $1.05 billion antitrust verdict against UST, upheld by the 6th Circuit. UST defense attorneys sought dismissal of the Pennsylvania suit based on lack of standing, and are now asking Buckwalter to certify an immediate appeal.

As the 3rd Circuit sees it, Pennsylvania public policy is not designed to reward heroics, but to encourage common sense. The panel overturned a lower court's ruling in favor of a man who was struck by his own car while trying to prevent the car's theft after he left the keys in the ignition. Insurance covered the theft of the car and medical bills, but a dispute arose when the man filed a claim for up to $500,000 in uninsured motorist coverage -- naming the unknown thief as the uninsured driver.
