A criminal defendant convicted of capital murder successfully proved on appeal that he was entitled to a new trial because the trial court failed to suppress evidence.

K.W. was arrested for capital murder. After institution of numerous orders to protect Texans from the COVID-19 pandemic, a grand jury consisting of six "in-person" jurors and six jurors who participated remotely by Zoom indicted K.W., who then filed a writ of habeas corpus asserting the emergency order was unconstitutional.

Appellee was charged with the third-degree felony of unlawful possession of a firearm by a felon and the state alleged habitual-offender enhancement paragraphs.

Appellant, R.C., a juvenile, challenged the trial court's adjudication order that found he engaged in delinquent conduct by committing the offense of felony murder.
