Invasion of the Lawyer Snatchers

The invasion of the Northeast's megafirms topped New Jersey's legal stories in 1999, a year that saw two venerable partnerships and dozens of smaller groups swept up in the tide of colonization. From the purchase of 110-lawyer Shanley & Fisher by Philadelphia's Drinker, Biddle & Reath to the defection of legions of lone lawyers, hardly a week passed without an announcement that a New York or Pennsylvania firm had gobbled up a partnership or a practice section.

Pitching the Patriot Act

John Ashcroft's Justice Department and the American Civil Liberties Union don't find themselves on the same side too often. But DOJ and ACLU Web sites focusing on the Patriot Act share a certain symmetry. On the DOJ site a banner reads, "Preserving Life and Liberty." On the ACLU site, the motto declares, "Keeping America Safe and Free." It's all part of dueling public relations campaigns that the Bush camp and its critics are waging as the controversial law comes up for renewal.

In an opinion made public Tuesday, a New Jersey district court dismissed with prejudice Apotex's antitrust claims against Daiichi.

Largest Private Law Offices

Clifford Chance once had aspirations to dominate New York. But a decade after it combined with Roger & Wells to become the fifth largest employer of lawyers in New York state, it is a shadow of its former self. The drop in Clifford Chance's headcount - the largest reduction citywide at a major law firm - was just one of the findings of this year's NYLJ 100.

Challenge to HMO's Care Guidelines Survives

A Manhattan judge has given the go-ahead to a class action against a leading HMO for letting personnel other than doctors decide what length of hospital stay will be covered. In denying the Prudential Insurance Company's bid to dismiss the case in its entirety, Supreme Court Justice Herman Cahn said the suit can proceed even though the plaintiffs had failed to exhaust their remedies under the insurance contract. The judge refused, however, to declare the insurance contracts void on public policy grounds.

Crossing Cultures

When dealing with Asian clients, be careful how you handle business cards, and be attentive to who sits where. In Latin countries, be prepared for two-hour meals before talking business. In China, save the small talk for after the deal. And in France, you may want to arrive to a meeting fashionably late. Globalization of the legal world has led more lawyers to travel overseas and work with foreign clients, so grasping another country's customs can make or break a deal.
