The Asarco bankruptcy was a huge success, resulting in full payment to all creditors and the emergence of a going concern. Baker Botts, the debtor's counsel, wants the judge to approve a total of about $142 million in fees and expenses. But Asarco is now owned again by its former parent, which Baker Botts whipped to the tune of a $6 billion fraudulent conveyance judgment in the Chapter 11. And--no surprise--the vanquished opponent doesn't want to pay up.

Coercive Jury Instructions Lead to Drug Conviction Upset

A judge who told a deadlocked jury its job was "to get a result" coerced it into returning a guilty verdict five minutes later, New York's Court of Appeals has ruled. The Appellate Division, 1st Department, had earlier reversed the conviction in a 3-2 decision identifying five errors in the trial judge's charge. The Court of Appeals agreed with the 1st Department majority, and admonished trial judges to strike an appropriate balance in jury instructions.
