A New Jersey judge has discovered that a clerk's failure to switch on a tape recorder caused a two-hour gap in the verbatim record of the trial that led to the largest liquor-liability award in U.S. history. "The absence of a verbatim record of any portion of the trial record raises a question of fairness," Judge Mary Cuff said.
