Affidavit of Merit Needed to Sue Firm as Well as Lawyers for Malpractice, N.J. Court Rules

New Jersey's affidavit-of-merit statute applies to suits against law firms for malpractice, not just individual lawyers, an appeals court held Monday in a case of first impression. The judges rejected the argument that a firm cannot be a "licensed person" within the statute's meaning. Because no prior court had squarely addressed the issue, the panel allowed a malpractice suit to go forward despite a late-filed affidavit of merit.

A New Jersey judge has discovered that a clerk's failure to switch on a tape recorder caused a two-hour gap in the verbatim record of the trial that led to the largest liquor-liability award in U.S. history. "The absence of a verbatim record of any portion of the trial record raises a question of fairness," Judge Mary Cuff said.
