Remembrance of Purpose

By Joseph R. Bankoff, Special to the Daily ReportYoung lawyers sometimes ask me why I went to law school. Remembering Why I Went to Law School

Young lawyers often ask seasoned veterans why they went to law school. A common response from baby boomers is, "I wanted to improve the world." In that vein, King & Spalding senior partner Joseph R. War of the Words: Pleaded vs. Pled

There is a bitter, friend-splitting debate raging among lawyers about whether to use "pleaded" or "pled." Both words get a lot of play in legal writing. We think that it's time for one usage to rule them all — but we disagree about which word to send to the dustbin. Chandler always uses "pled." Boone always uses "pleaded." The gloves are off.

DuPont Suits Surface Again

Today, plaintiffs in Fuku-Bonsai v. DuPont, 98-15429, will argue before the Ninth Circuit U.S. Court of Appeals that the general releases they signed when they settled do not preclude them from suing DuPont for fraud and racketeering. For years, DuPont maintained that its fungicide Benlate was not contaminated with an herbicide. In 1994, a San Francisco attorney made a startling discovery that has resulted in scores of Benlate-related suits that may blow up the previously reached settlements.

Who Protects IP America: 2005

Boutiques have disappeared, litigation has exploded, and patents have become a corporate profit center. But one thing has remained stable in the IP world: the firms who protect corporate America's IP jewels. IP Law & Business' annual survey asks the Fortune 250 to name their primary IP firms. Although rankings have shifted, the top 10 has held steady over the years. This year Jones Day made the biggest leap, moving from 10th place to tie Kirkland & Ellis for first place.
