Foreign Plaintiffs Can Bring Benlate Lawsuits in Delaware

The Delaware Supreme Court has opened the door to Benlate lawsuits against DuPont, producer of the controversial fungicide that is alleged in numerous lawsuits to cause birth defects. The court reversed a lower court's finding that a lawsuit brought on behalf of six children born in England, Scotland, Wales and New Zealand should be heard in those countries. The children suffer from severe eye defects allegedly caused by their mothers' exposure to Benlate.

An internal review, conducted by the Civil Rights Division's Employment Litigation Section, carefully studied the tests routinely administered to applicants for jobs in each of the department's major components. The conclusion: The testing of those hoping to become Border Patrol agents, INS detention enforcement officers, and others has resulted in bias against African-Americans and Hispanics.
