Steinbeck Descendants Lose Bid to Renegotiate Publishing Rights

A 1994 agreement signed by the widow of John Steinbeck trumps a claim made by two of the late author's heirs under copyright law, a federal appeals court ruled Aug. 13. Reversing a lower court, the U.S. Court of Appeals for the Second Circuit said a 1938 agreement in which John Steinbeck gave the sole and exclusive rights to publish "Of Mice and Men" and several other works was terminated and superceded by a 1994 agreement between Elaine Steinbeck and Penguin Books.

Judge Rules for U.S. Company, Against Russian Agency

In a decision delving into abstract areas of Russian and U.S. law, a federal judge has turned down a Russian agency's attempt to wrest control of copyrights held to be legitimately granted to a U.S. company. Eastern District of New York Judge David Trager rejected a motion by the Russian agency to apply the so-called act of state doctrine -- which requires U.S. courts to defer to foreign government actions on their own soil -- in its favor.

An online nudie magazine's copyright infringement suit against Google now requires some complex maneuvering after a 9th Circuit panel on Wednesday severely limited what it could argue. Perfect 10 magazine sued Google for providing thumbnail versions of images from the magazine. "We conclude that the significantly transformative nature of Google's search engine, particularly in light of its public benefit, outweighs Google's superseding and commercial uses of the thumbnails in this case," the court wrote.
