Florida Appellate Court Strikes Limit on Day Laborer Transportation Fees

A Florida appellate court has ruled that a state law requiring that temporary labor staffing companies charge day laborers a "reasonable" transportation fee to worksites is unconstitutionally vague. The court upheld the dismissal of a plaintiff day laborer's suit brought under the Florida Labor Pool Act. An attorney for defendant Workers Temporary Staffing said the statute may nevertheless survive as it stands, because a subsequent section of the law outlines specific pricing amounts.

Appeal Planned Over Day Laborers' Transportation Costs

Down on his luck, Larry Liner began work as a day laborer, but according to attorney David George, the company overcharged him for transportation to his jobs. The suit was one of eight George has filed in Florida on day laborers' behalf, claiming that the transport charges violated the 1995 Labor Pool Act. Last month, a judge declared the previously untested act unconstitutional, possibly leading to an important appellate test of the statute, which offered unprecedented protection for thousands of workers.
