Court Denies 9/11 Families' Challenge to WTC Memorial Site

The embattled billion-dollar World Trade Center memorial has taken a small step toward fruition. A Manhattan judge has dismissed a challenge filed by the Coalition of 9/11 Families, which sought to enjoin the Lower Manhattan Development Corporation from pouring concrete on the "footprint" of the North Tower, as set forth in the memorial's blueprint. The plaintiffs argued that the design effectively obliterates the final resting place of many 9/11 victims. The judge dismissed the case as time-barred.

Creditors' Committees May Pursue Derivative Avoidance Actions

In a highly anticipated decision, a divided en banc 3rd Circuit panel ruled that a creditors' committee in a Chapter 11 case can be authorized by the bankruptcy court to pursue a lawsuit that the debtor itself opted not to. The court rejected the argument that the Bankruptcy Code specifically limits the power to bring such suits to bankruptcy trustees. But the dissenters said the decision directly conflicts with U.S. Supreme Court case law.
