Judge: Order Unclear, CIBA Not Held in Contempt

In a lawsuit filed under the Lanham Act challenging CIBA Vision's marketing of a new line of contact lenses, a federal judge has ruled that CIBA will not be held in contempt of court for violating an agreement not to print statements comparing its product with Johnson & Johnson's contact lenses. However, Judge Laura Taylor Swain refused to grant CIBA's request for summary judgment, allowing Johnson & Johnson's request for damages as a result of CIBA's advertising campaign to go to trial.
