Fixating on Fee Systems for Outside Litigators

Alternative billing, despite enjoying a brief vogue in the 1990s, has never caught on as a payment method between companies and their outside counsel. However, at least three big corporations are bucking the trend. Cisco, Tyco and Unocal have each cut fixed-fee deals with outside litigators and say they have reaped benefits that go beyond just saving money. For starters, fixed fees mean that in-house lawyers can bring outside counsel in more often and earlier, increasing the chances for a speedy resolution.
