Qui Tam Suit Against University Nets $78.5 Million Settlement

Plaintiffs lawyers struck a $78.5 million deal in a long-running false claims suit that accused the University of Phoenix of rewarding recruiters for enrolling students, according to a settlement agreement announced Monday. The deal, which includes $11 million in attorney fees for the plaintiffs, is among the largest settlements of a False Claim Act fraud case in which the government didn't intervene, said a qui tam expert. Plaintiffs attorney Cliff Palefsky noted that "the win rate is ridiculously low" in such cases.

Senior U.S. District Court Judge Thelton Henderson withheld final approval of a class action settlement on behalf of African-American retail brokers at Morgan Stanley after hearing objections Monday that the deal was "lawyer driven." Linda Friedman, an attorney for about 30 brokers, claimed that James Finberg and other class counsel fished for a lead plaintiff after they already negotiated the settlement -- $16 million plus diversity protocols -- with defense lawyers at Morgan, Lewis & Bockius.

Judge Slashes Fees in Microsoft Class Action

San Francisco-based Townsend and Townsend and Crew is getting less than half the attorney fees it sought for winning a $1.1 billion California consumer class action against Microsoft. San Francisco Superior Court Judge Paul Alvarado awarded 35 firms $112.4 million in fees and costs, saying the $270 million requested was unwarranted given the relatively low level of risk it faced in pursuing the case.
