California's Commission on Judicial Performance has initiated formal proceedings against a judge it says tried to use her position and that of her husband, a state appeals court justice, to avoid arrest for driving under the influence of alcohol. At the scene of her arrest, Judge Elaine Rushing allegedly said she had not been driving and had been sitting in the back seat, even though her Porsche sports car had no back seat. The complaint alleges that Rushing "repeatedly" told officers that she was a judge.Danser Attorney Wants CJP Investigation Put On Hold
Santa Clara County Superior Court Judge William Danser, who now faces both criminal and Commission on Judicial Performance charges of ticket-fixing, wants to halt the judicial watchdog's investigation until the criminal trial is over. Attorney James Murphy said prosecutors and CJP investigators have already been trading tips on Danser. He said the stay is necessary to protect Danser's Fifth Amendment rights and prevent prosecutors from gathering incriminating statements from CJP hearings.The List: New Partners in California 2007
