The U.S. Court of Appeals for the Third Circuit has ruled that the pension plan for St. Peter’s Healthcare System in New Brunswick is not entitled to a religious exemption from certain provisions of the Employee Retirement Income Security Act.

The appeals court said in a precedential ruling that the St. Peter’s pension plan is not entitled to a so-called “church plan” exemption from ERISA because it was not established by a church.
