Concurrent resolutions have been introduced in the Legislature that if adopted and subsequently approved by the electorate would amend the New Jersey Constitution “to ensure the people’s environmental rights.” SCR-43 and ACR-119. The Senate version of the so-called “Green Amendment” has two primary sponsors and 17 co-sponsors. Similar measures have been introduced since 2017. Although the stated purpose is laudable, its adoption would not lead to the attainment of that objective and would only result in costly and unproductive litigation.

On March 14, 2024, the Senate Environment and Energy Committee released the proposal with amendments. The measure has been referred to the Senate Budget and Appropriations Committee for its consideration.
