A Brooklyn federal judge has lifted the desegregation order he issued in 1974 for Brooklyn's Mark Twain Intermediate School 239, finding that the conditions that necessitated the court's intervention no longer exist. Judge Jack B. Weinstein added, however, that School District 21 may still consider race as an admissions factor, rejecting the argument that a U.S. Supreme Court decision from last year precludes racial balancing.
