REVERSING himself, a Westchester County judge has ruled that commercial antennas attached to cell towers on state property along a highway, but in the city of New Rochelle, are subject to New Rochelle’s local regulations.

Justice Nicholas Colabella in Crown Communication New York Inc. v. City of New Rochelle, 7863/01, filed last week in Supreme Court, Westchester County, granted leave to reargue to New Rochelle, and upon considering the new arguments, he modified his order issued last November finding that two cell towers in New Rochelle were exempt from local zoning regulation.
