THE BATTLE being waged by the New York County Lawyers’ Association to raise assigned counsel rates cleared a major hurdle yesterday, when the Appellate Division, First Department, refused to dismiss the group’s lawsuit.
The First Department’s unanimous ruling leaves in place a preliminary injunction, issued by Justice Lucindo Suarez a week ago, which raises the pay rates of assigned counsel for the poor to $90 an hour.
