MINEOLA – Retailers and commercial property owners in Nassau that filed a group of actions known collectively as the “garbage cases” have failed to convince a State Supreme Court justice that they are exempt from paying an estimated $8 million in solid waste collection taxes.

Justice Ralph P. Franco ruled in seven different decisions that J.C. Penney, K-mart, Fortunoff and other commercial property owners were precluded by stare decisis from pursuing their lawsuits against the Town of Hempstead.
