ALBANY – Three years after striking down a New York City program that allowed police officers to conduct suspicionless checks on taxi cabs, the Court of Appeals yesterday unanimously upheld a similar law designed to protect livery drivers.
The Court declined, however, to decide whether a passenger has an independent expectation of privacy that would implicate the third-party consent doctrine.
