MINEOLA – An acting State Supreme Court Justice has overturned the conviction of a man found guilty in the judge’s own criminal court of rape after ruling that he erred when he brought in a substituted juror without instructing deliberations to start anew.

Justice Alan L. Honorof ordered a new trial for Rogelio Ferraro after finding that in presiding over the trial, he violated criminal procedure law when he told the jurors to bring the new juror “up to speed” after deliberations had begun in the trial.
