ALBANY – Celebrity chef Kyle Connaughton cannot sue Chipotle Mexican Grill Inc. for fraudulently leading him to believe it could develop a “high-quality ramen” fast-food restaurant chain, New York’s highest court ruled Tuesday.

The 5-0 Court of Appeals upheld the summary dismissal of Connaughton v. Chipotle Mexican Grill, 46, by two lower courts. The judges found that Connaughton failed to show that he suffered actual monetary damages as the result of the failed alliance with Chipotle, as he must under the state’s fraudulent inducement statute and precedents.
