Prosecutors are now appealing the suppression of wiretap evidence by a judge who said a federal agent perjured himself on a wiretap application.

In a narcotics gang prosecution using GPS data gleaned from a paroled defendant’s electronic monitoring bracelet, Eastern District Judge Jack Weinstein said a Homeland Security Investigations agent wrongly swore in a 2015 affidavit there had been no prior wiretaps on targets in the investigation.
