Appellate Justices expressed skepticism on Wednesday during an appeal of a vacated 1990s murder conviction tied to a tourist mugging that symbolized the era’s out-of-control crime.

Benjamin Rosenberg, general counsel to the Manhattan District Attorney’s office, fielded tough questions about the case, including the testimony of Mariluz Santana, a witness to the subway mugging who came forward in 2015—25 years after the incident. Santana had said she was acquainted with defendant Johnny Hincapie and that, when she saw the 1990 mugging happen, he was not there.
