ALBANY – A state appeals panel declined Tuesday to hold St. Lawrence County District Attorney Mary Rain in criminal contempt for her office’s repeated failures to file the prosecution’s papers in criminal appeals.
The Appellate Division, Third Department, agreed 4-0 to dismiss its three contempt motions against Rain, whose office failed for weeks to file briefs it promised in three cases and ignored the court’s inquiries about when the filings would be made.
