A police officer’s use of force to clear an area may violate an individual’s constitutional right against seizure, a federal appeals panel has ruled regarding a 2010 incident in an Albany courthouse.

The U.S. Court of Appeals for the Second Circuit decided in Salmon v. Blesser, 14-1993-cv, that plaintiff Oliver Salmon’s Fourth Amendment claim should be revived against the city of Albany, its police department and Officer Thomas Blesser.
