A federal court has dismissed a suit claiming a man was illegally thrown out of an upstate courthouse by a judge who had presided over part of the man’s divorce case.
Northern District Judge Thomas McAvoy said that although Chenango County Supreme Court Justice Kevin Dowd recused himself from the rest of Moshe Shtrauch’s divorce case, the judge was still protected by judicial immunity when he ordered court personnel to remove Shtrauch from the courthouse in November 2014.
