The U.S. Supreme Court is being asked to review the conviction of a man authorities said left liquid mercury in several public areas of the Albany Medical Center because he was unhappy about the care and the bill he received at the hospital.

Martin Kimber, 62, is challenging whether he should have been subject to prosecution under the federal Chemical Weapons Convention Implementation Act. He is seeking a writ of certiorari, arguing that his placement of about six pounds of mercury at the medical center between March 2011 and March 2012 did not pose a public threat sufficient enough to warrant his prosecution under the chemical weapons statute, 18 U.S.C. §229(a)(1).
