ALBANY – A Family Court judge was on “sound and substantial” ground when he ordered an inmate to receive regular visits from his young son, despite objections from the child’s mother that the boy believes another man is his father and that she does not want to tell him otherwise, an appellate court has ruled.

A unanimous panel of the Appellate Division, Third Department, found that Warren County Family Court Judge J. Timothy Breen weighed the competing interests presented in Kadio v. Volino, 518400, and balanced them against the best interests of the child.
