A negligence and fraud suit may proceed against an animal shelter for allegedly making a dog with vicious propensities available for adoption, an Appellate Division, Third Department panel ruled.

Edgar Lawrence contends that the North Country Animal Control Center of Malone, Franklin County, failed to warn him that the basset hound named Brutus he adopted in July 2010 had been turned over to an animal shelter in Pennsylvania for euthanasia after it attacked its former owner and her child.
